‘Easy To Make Sweeping Statement’: SC Directs Center To File Report On Hate Crimes Against Chr

The Supreme Court on Wednesday directed the Center to file a report on the implementation of its earlier guidelines to prevent hate crimes as well as alleged attacks on Christian institutions and priests across the country.

A bench of Chief Justice DY Chandrachud and Justices PS Narasimha and JB Pardiwala directed the Union Ministry of Home Affairs (MHA) to collate and file before it a report on the states’ compliance with the court’s guidelines.

Senior advocate Colin Gonsalves, counsel for the petitioner, said that nodal officers have been notified in every district, but they are not registering cases even though hate speech has been given during rallies in Uttar Pradesh and Chhattisgarh and such reports are regular. Visually visible, following which the court passed the direction. on television and in newspapers.

Additional Solicitor General Aishwarya Bhati opposed the submission made by Gonsalves, saying that “it is easy to make sweeping statements”.

The CJI then said, “Let the Ministry of Home Affairs file the reply…we can have it after two weeks.” In 2018, the apex court issued several guidelines for the Center and states to deal with hate crimes. These included fast-track trials, compensation to victims, harsher punishment and disciplinary action against officials who enforced lax laws. The court said that crimes like hate crime, cow protection and lynching should be rooted out.

The court had said that the states shall nominate a senior police officer not below the rank of superintendent of police as the nodal officer for the implementation of the guidelines in each district. A DSP-rank officer to take measures to prevent mob lynching and incidents of mob lynching.

The court had said that the state governments should immediately identify those districts, sub-divisions and villages where incidents of lynching and mob lynching have come to the fore.
