With more than 400 applications received as of August 31, 2023 and the establishment of the entire legal and doctrinal framework, CAPADD allows the exercise of the right of access to the origins of people born from ART with a third party. donor, laying the foundation for solid development in the future.
The Commission on access to third-party donor data for people born through medically assisted procreation (CAPADD)created on September 1, 2022 in application of the law of August 2, 2021 relating to bioethics, closed its first year of exercise on August 31, 2023 and adopted its activity report 2022-2023 during its meeting on September 15, 2023.
Reporting to the Minister responsible for Health and installed by the Minister Delegate Agnès FIRMIN LE BODO on September 7, 2022, the commission is chaired by Ms. Stéphanie KRETOWICZ, judicial magistrate, and brings together representatives of associations, doctors, magistrates and personalities qualified. and representatives of the ministries.
The commission is responsible for implementing the right of access to origins opened by this law for the benefit of adults born through medically assisted procreation with third-party donors of gametes or embryos.
These people can, if they wish, request access to the donor’s identity (identity data / “DI”: birth name, surname, sex, date and place of birth), as well as their non-identifying data (“DNI”). “)”: age, general condition, physical characteristics, family and professional situation, country of birth, motivations for donation written by them).
During this first year of work, CAPADD established a doctrine that makes the exercise of the right of access to the origins of people born from an AMP with a third-party donor concrete and operational, laying the foundations for solid development for the future.
As of August 31, 2023, the commission received 434 admissible requests for access to the DI and/or DNI.
Thanks to the research carried out by doctors and health professionals from the 26 donation centers contacted by the commission, 101 donors could be identified.1 in 2 donors among the donors contacted and who have responded to date have given their consent for the communication of their data.

The commission was able to send 77 response letters to the applicants including 25 announcing the death of the donor and 3 positive responses to DI and/or DNI requests.
In the other cases, the commission informed the applicants of the donor’s expressed refusal or of the fact that the donor could not be identified in the existing records.
The commission received 435 spontaneous consents from former third-party donors for the communication of their DNI and DNI.
Finally, the commission has launched and deployed elements of information and support for applicants and donors.
At the end of this first year, particularly dense and rich in lessons, nourished by the diversity and experience of its members, the commission formulated several recommendations aimed at improving the system and which appear in its first activity report.
